Overview
This website and the online courses, lectures, question banks, slide decks, downloadable files, and related services offered under the brand "Dr. Miguel INBDE Prep" (collectively, the "Services") are operated by Manuel Miguel, doing business as Dr. Miguel INBDE Prep ("we," "us," or "our"). The Services are hosted on the Thinkific platform.
By creating an account, purchasing a product, or accessing any part of the Services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy (www.drmiguelinbde.com/pages/privacy), which is incorporated by reference. If you do not agree to these Terms, do not use the Services.
We may update these Terms from time to time by posting a revised version on this page. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
Section 1 – Eligibility and Accounts
You must be at least 18 years old to create an account or make a purchase. By using the Services you represent that you are at least the age of majority in your jurisdiction of residence.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when you register and to keep it up to date. Notify us promptly at [email protected] if you suspect unauthorized use of your account.
Accounts are personal and non-transferable. Each account may be used only by the individual who purchased it. Sharing, lending, or selling access to your account is prohibited and is grounds for immediate termination without refund.
Section 2 – Nature of the Services; Educational Disclaimer
The Services are exam-preparation and continuing-education materials intended to help dentists prepare for the Integrated National Board Dental Examination (INBDE). The content is provided for educational purposes only.
• No guarantee of results. We do not guarantee that you will pass the INBDE, obtain a license, or achieve any particular score. Exam outcomes depend on many factors outside our control.
• No affiliation. Dr. Miguel INBDE Prep is an independent preparation service. We are not affiliated with, sponsored by, or endorsed by the American Dental Association (ADA), the Joint Commission on National Dental Examinations (JCNDE), or any state dental board. "INBDE" and related marks belong to their respective owners and are used solely to describe the exam our materials are designed to help you prepare for.
• Not clinical advice. Our materials are not a substitute for professional clinical judgment, official examination materials, or authoritative dental references. Nothing in the Services should be relied upon to diagnose or treat any patient.
• Bilingual content. Some explanations are provided in both English and Spanish for study convenience. In the event of any discrepancy, the English version controls, and the English version of these Terms governs.
Section 3 – Accuracy of Information
We make reasonable efforts to keep our materials accurate and consistent with current professional guidelines, but we do not warrant that all content is complete, current, or free of errors. Exam content, guidelines, and clinical standards change over time. We reserve the right to correct, update, add, or remove content at any time without notice and without liability.
Section 4 – Products, Pricing, and Availability
We offer one-time purchases (for example, individual courses or bundles) and recurring subscriptions. Product descriptions, inclusions, and prices may change at any time without notice. We reserve the right to discontinue any product, limit quantities, refuse any order, or restrict sales to any person, region, or jurisdiction at our sole discretion.
Access to a one-time purchase continues for the access period stated on the product page at the time of purchase (or, if none is stated, for as long as the product remains available on the Services). Access may end if the product is discontinued or if your account is terminated under these Terms.
Section 5 – Subscriptions and Automatic Renewal
If you purchase a subscription, you authorize us (through our payment processor) to charge your payment method the subscription fee at the start of each billing period.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly, annual, or as stated at checkout) at the then-current price until you cancel.
• Cancellation. You may cancel at any time from your account settings or by emailing [email protected]. Cancellation takes effect at the end of the current billing period; you will retain access until then. No prorated or partial refunds are issued for unused time.
• Price changes. We will give you reasonable advance notice by email before any price change takes effect on your next renewal.
• Failed payments. If a renewal payment fails, we may suspend or terminate your access until payment is received.
Section 6 – Refund Policy
All sales are final. We do not offer refunds, credits, or exchanges on any product or subscription, including one-time purchases, subscription fees, renewals, and unused portions of a billing period. Because our products are digital and become available immediately after purchase, they cannot be "returned."
Before purchasing, please review the product description, sample content, and system requirements carefully. If you have questions about whether a product is right for you, contact us at [email protected] before completing your purchase.
Exceptions may be made at our sole discretion where required by applicable law or in the case of a verified duplicate charge.
Chargebacks. If you initiate a chargeback or payment dispute for a purchase you made, we reserve the right to suspend or terminate your account and to provide our payment processor with evidence of your purchase, account activity, and acceptance of these Terms.
Section 7 – Billing Information
You agree to provide current, complete, and accurate purchase and billing information. Payments are processed by third-party payment processors (such as Stripe or PayPal) through the Thinkific platform. We do not store your full payment card details. Your use of a payment processor is subject to that processor's own terms and privacy policy.
Section 8 – Intellectual Property and License
All content on the Services—including videos, lectures, slide decks, PDFs, exam-style questions, explanations, clinical cases, graphics, logos, and the "Dr. Miguel INBDE Prep" and "PassPort" names and marks—is owned by or licensed to Manuel Miguel, doing business as Dr. Miguel INBDE Prep and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
Upon purchase we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the purchased content for your own individual study. You may not, without our prior written permission:
• download (except where a download button is expressly provided), record, screen-capture, copy, reproduce, or transcribe any video, lecture, question, or explanation;
• share, publish, post, upload, sell, resell, rent, distribute, or otherwise make any content available to any third party, including in study groups, messaging apps, social media, or file-sharing sites;
• create derivative works, translations, or compilations based on our content, or use it to build a competing product or question bank;
• remove, obscure, or alter any copyright notice, logo, or watermark;
• use any content to train, fine-tune, or prompt an artificial-intelligence model or automated system.
Any unauthorized use terminates your license immediately, may result in account termination without refund, and may expose you to civil and criminal liability. We actively monitor for unauthorized distribution of our materials.
Section 9 – Prohibited Uses
In addition to the restrictions above, you agree not to, directly or indirectly:
• use the Services for any illegal or unauthorized purpose or in violation of any applicable law, including copyright, data-protection, and privacy laws;
• attempt to obtain the password, account, or security information of any other user, or permit anyone else to use your account;
• circumvent or attempt to circumvent any access, licensing, timing, or usage restrictions built into the Services;
• reverse engineer, decompile, or otherwise attempt to discover the underlying structure of the Services;
• upload or transmit viruses, malware, or any code of a destructive nature;
• use any robot, scraper, or automated process to access, monitor, or copy any part of the Services;
• interfere with or disrupt the integrity or performance of the Services, or use bandwidth or resources in an unreasonable manner;
• post or submit any content that is unlawful, defamatory, harassing, obscene, or that infringes the rights of any third party.
We reserve the right to suspend or terminate your access for any violation of this Section.
Section 10 – User Submissions and Feedback
If you submit comments, questions, error reports, suggestions, or other feedback ("Feedback"), you grant us a perpetual, irrevocable, royalty-free right to use it without restriction or obligation to you. You represent that any content you post does not violate the rights of any third party. We may, but are not obligated to, monitor, edit, or remove user content at our discretion.
Section 11 – Third-Party Links and Tools
The Services may contain links to, or be delivered through, third-party websites and tools (including Thinkific, payment processors, video hosting, and community platforms) that we do not control. We are not responsible for the content, accuracy, or practices of third parties, and access to third-party tools is provided "as is" without warranty. Review the applicable third-party terms before use.
Section 12 – Personal Information
Your submission of personal information through the Services is governed by our Privacy Policy, available at www.drmiguelinbde.com/pages/privacy.
Section 13 – Errors, Inaccuracies, and Omissions
Occasionally information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or promotions. We reserve the right to correct any such errors and to change or update information or cancel orders if information is inaccurate, at any time without prior notice (including after you have submitted an order).
Section 14 – Disclaimer of Warranties; Limitation of Liability
We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free. The Services and all content are provided "as is" and "as available" without any representation, warranty, or condition of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the fullest extent permitted by law, in no event shall Manuel Miguel, doing business as Dr. Miguel INBDE Prep, its owners, directors, officers, employees, contractors, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages—including lost profits, lost opportunity, exam fees, or costs of retaking an examination—arising out of or related to your use of or inability to use the Services, even if advised of the possibility of such damages. Our total liability for any claim arising from the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations; in such jurisdictions our liability is limited to the maximum extent permitted by law.
Section 15 – Indemnification
You agree to indemnify, defend, and hold harmless Manuel Miguel, doing business as Dr. Miguel INBDE Prep and its affiliates, officers, directors, employees, contractors, agents, and licensors from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms, your violation of any law, or your infringement of the rights of any third party.
Section 16 – Termination
These Terms remain in effect until terminated by you or by us. You may stop using the Services at any time. We may suspend or terminate your access immediately, without notice or refund, if we determine or reasonably suspect that you have violated these Terms (including account sharing or unauthorized distribution of content). Sections 6, 8, 14, 15, 17, and 18 survive termination.
Section 17 – Governing Law and Dispute Resolution
These Terms and any separate agreement under which we provide the Services are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules, and by applicable U.S. federal law. You agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in St. Johns County, Florida, and you consent to the personal jurisdiction of those courts. Before filing any claim, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
Section 18 – General Provisions
• Severability. If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in full force.
• Entire agreement. These Terms, together with our Privacy Policy and any policies posted on the Services, constitute the entire agreement between you and us and supersede any prior agreements or communications.
• No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• Language. These Terms are written in English. Any translation is provided for convenience only; the English version controls.
